For the purposes of the GDPR, the data controller responsible for determining the purpose and scope of the processing of personal data provided through any functionality of this website is Penta Real Estate, s.r.o. (hereinafter referred to as “PRE” or “Data Controller PRE”), with its registered seat at Digital Park II, Einsteinova 25, Bratislava 851 01, Company ID No. (IČO): 51 284 502. PRE is entered in the Business Register of the District Court Bratislava I, section: sro, file no. 124856/B. The Joint Controllers for the information system of the IS Marketing Group are PRE and Penta Investments, s.r.o., with their registered seat at Digital Park II, Einsteinova 25, Bratislava 851 01, Registered Number: 47 258 896, entered in the Business Register of the District Court Bratislava I, section: Sro, file no. 124855/B (hereinafter referred to as "Joint Controllers"). 
 

Collection of Personal Data 

 

This policy applies to the processing of personal data that we collect directly from you when you: 

 

(a) fill out the contact form; 

(b) request newsletters; 

(c) provide feedback; and 

(d) provide personal data via telephone or email communications using the contact details provided on this website

Personal Data We Process 

 

For the purposes specified below in section 4 of this policy, we process personal data of: 

  • individuals interested in purchasing flats or in purchasing or leasing non-residential spaces in PRE’s real estate projects; 
  • individuals interested in receiving information about current real estate offers from PRE; and 
  • individuals that the Joint Controllers wish to contact for the purpose of their marketing activities. 

 

However, the personal data we collect are processed in accordance with the principle of data minimization enshrined in the GDPR, hence processed only as necessary and to the following extent: full name, email address, and phone number. 

 

We do not process special categories of personal data under the GDPR or personal data of individuals under the age of 16. 

 

It is crucial that the personal data we process about you are accurate and up to date. Please inform us in case your personal data change during their processing. 

 

Purposes of Personal Data Processing 

 

We process your personal data for the following purposes: 

 

  • to communicate with you and provide responses or feedback to the inquiries or initiatives expressed by you through any of the functionalities of this website or through the use of contact details provided on this website; 
  • for the lawful marketing purposes of the Joint Controllers; and 
  • for the purposes of administration and protection of the website. 

 

In case we process your personal data for direct marketing purposes, such as sending newsletters, you will always have the option to unsubscribe at any time in the future if you no longer wish to receive them. 

 

Personal data processed for the marketing purposes of the Joint Controllers are processed in a separate information system of the IS Marketing group, based on an agreement between the Joint Controllers. 

 

Legal Basis for Personal Data Processing 

 

The processing of your personal data for the purposes described above in section 4, paragraph (a) (i.e., communication based on your expressed interest) and for the purposes described in paragraph (b) (i.e., marketing activities of the Joint Controllers) is based on our legitimate interest in (i) active communication with individuals who expressed their interest in properties from our real estate portfolio and (ii) effective marketing support and promotion of our business activities and our real estate portfolio offer. Although our legitimate interests serve as the legal basis for processing of your personal data, we always respect and prioritize your rights and interests over ours. 

 

In cases where personal data is processed for the purpose of managing and protecting this website, as described in section 4, paragraph (c), the legal basis for processing personal data is also a legitimate interest, which includes providing IT services and ensuring security. 

 

The processing of your personal data on the basis of our legitimate interest, complies with Article 6(1)(f) of the GDPR. Nonetheless, you have the right to object to the processing of your personal data at any time. If you wish to do so, please feel free to contact us in writing at the address of our registered seat provided at the beginning of this policy, or by emailing: GDPR_PRE_SR@pentarealestate.com. We will thoroughly assess each objection and inform you of the outcome. 

Duration of Processing Your Personal Data

 

We retain your personal data for the period necessary to fulfill the purposes for which they were collected. The retention period for your personal data is five (5) years from the date of collection. We regularly review the retention period, and upon its expiry, we will cease processing your personal data and either delete or securely destroy them. 

 

Sharing Your Personal Data with Third Parties 

 

In accordance with the purposes specified in this policy, your personal data is also processed by third parties. 

 

These third parties are service providers used by Data Controller PRE to facilitate the processing of your personal data for the purposes stated in this policy. Specifically, these services include technical and software support, and the administration of marketing and sales activities by Data Controller PRE, and companies through which Data Controller PRE undertakes development, construction, and sale of properties in various real estate projects, alongside the Joint Controllers. 

 

A third party is Bavint, s.r.o., with its registered seat at Digital Park III, Einsteinova 25, Bratislava - Petržalka 851 01, Company ID No. (IČO): 36725994, entered in the Business Register of the District Court Bratislava I, section: sro, file no. 44126/B, through which Data Controller PRE conducts development, construction, and sales of properties within the Pri Mýte project. 

 

Another third party is Invelity s.r.o., with its registered seat at Strážska cesta 22 - Zvolen 960 01, Company ID No. (IČO): 47455411, entered in the Business Register of the District Court Banská Bystrica, section: sro, file no. 25341/S, through which Data Controller PRE conducts development, construction, and sales of properties within the Pri Mýte project. 

 

A company specializing in web support and marketing communications also acts as a sub-processor in managing your personal data. 

 

Regarding cookies that do not require consent under the Cookie Policy (see link above), our processors include the following companies: 

 

  • Google Ireland Ltd., Gordon House Barrow Street, Dublin 4, DO4E5W5, Ireland, CRO: 368047, in relation to the processing of Analytical Cookies via Google Analytics; 
  • Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, CRO: 462932, in relation to the processing of Analytical Cookies via Facebook Pixel. 
  • Data Controller PRE has formal data processing agreements with these processors. 
  • Both the processors and sub-processors are bound to handle your personal data exclusively for the purposes specified in this policy. Your data will not be disclosed to third parties for independent use or processing beyond these specified purposes. 


International Transfer of Your Personal Data 

 

The software system used to process your personal data under a license agreement between Data Controller PRE and the software system provider is stored on the provider’s servers located in the United Kingdom of Great Britain and Northern Ireland. 


Your Rights in Relation to the Processing of Your Personal Data 

 

The GDPR grants you a comprehensive set of rights, which we fully respect, allowing you to exercise them to the full extent. In exercising your rights, you are particularly entitled to: 

  • request a copy of the personal data we hold about you and a description of how we use these data; 
  • request the correction of your personal data if you believe these data may be inaccurate, outdated and/or incorrect; 
  • request the erasure of your personal data if they are processed based on your consent; 
  • request the transfer of your personal data, which we process by automated means, based on your consent, to a third party; 
  • request, under certain limited circumstances, that we limit the use of your personal data or the purpose for which they are processed; 
  • object to the processing of your personal data, under certain circumstances, since we process them on the basis of our legitimate interests.
